THE HON'BLE SRI JUSTICE P.KESHAVA RAO WRIT PETITION No.1845 OF 2020 ORDER:

Heard the learned counsel for the petitioners as well as the learned Standing Counsel appearing for the 2nd respondent Corporation.

The prayer sought in the writ petition is as under: "For the reasons stated in the accompanying affidavit, it is hereby prayed that this Hon'ble Court may be pleased to issue a writ, order or direction, particularly one in the nature of Writ of Mandamus, declaring the action of the respondents in not considering the representation dated 20.01.2020 submitted by the petitioners for demolish the house bearing H.No.1-6-906 to 16-916, Zamistanpur, Musheerabad, Hyderabad which is in dilapidated condition belonging to the petitioners and also to declare the action of the respondents in not permitting the petitioners to demolish the said old house as the same is illegal and arbitrary and consequently direct the respondents to give permission to the petitioners for demolition of old H.No.1-6-906 to 1-6-916, Zamistanpur, Musheerabad, Hyderabad and to pass such other order or orders as this Hon'ble Court may deems fit just and proper in the circumstances of the case." 3.

The learned counsel for the petitioners submits that they are the absolute owners and possessors of the house bearing H.Nos.1-6-906 to 1-6-916, situated at Zamistanpur, Musheerabad, Hyderabad. Their father purchased the above said premises in the year 1959 vide document bearing No.2588/1959 in the office of SRO, Chikkadpally, Hyderabad. Since the date of purchase, they have been in possession and enjoyment of the same. The learned counsel also further

PKR,J W.P.No.1845 of 2020 submits that the petitioners submitted representation, dated 20.01.2020, to the respondent Corporation requesting to take necessary action immediately since there is every probability of serious loss and public hardship.

The learned Standing Counsel appearing for the respondent Corporation submits that the petitioners submitted the representation, dated 20.01.2020, only on 23.01.2020 and filed the present writ petition on 24.01.2020. Therefore, it is not possible for the respondent Corporation to pass appropriate orders without giving sufficient time.

In these circumstances, this Court is of the opinion that a direction to the respondent Corporation to dispose of the said representation within a stipulated period would meet the ends of justice.

Accordingly, the Writ Petition is disposed of directing the respondents to consider the representation, dated 20.01.2020, submitted by the petitioners and pass appropriate orders, as per law, within a period of three (03) weeks from the date of receipt of a copy of this order.

Pending miscellaneous petitions, if any, shall also stand dismissed. No order as to costs.
