ORDER:
The petitioner is an employee of the Telangana State and was on deputation to the Ministry of Home Affairs, Government of India. The petitioner was posted to the Bureau of Immigration under the control of the Ministry of Home Affairs on deputation. The petitioner challenges the office order No.383/2015, dated 11.09.2015, terminating the deputation and repatriating him to the parent unit.
2. The said order is passed by the Foreigners Regional Registration Officer, Bureau of Immigration, Government of India, Hyderabad (2nd respondent). The 2nd respondent being under the control of Government of India and the petitioner was on deputation to Government of India, if any grievance is raised against such premature repatriation to the parent State, as the grievance is against the subordinate office of the Central Government, the petitioner has to avail the remedy available under the Administrative Tribunals Act, 1985, before the Central Administrative Tribunal constituted under Section 14 of the Administrative Tribunals Act, 1985. Thus, the writ petition is not maintainable.
3. Accordingly, the Writ Petition is dismissed, granting
liberty to the petitioner to avail the remedy as available under the Administrative Tribunals Act, 1985. There shall be no order as to costs. Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
