The revision is directed against order dated 08.12.2016 in I.A. No.211 of 2016 in O.S. No.246 of 2012 in the Court of II Additional Senior Civil Judge, Nandyal. The revision is filed by the 1st defendant in the suit. Respondents 1 to 3 filed I.A. No.211 of 2016 for a direction to respondents 1 to 3 herein as well as revision petitioner and Smt.Annapurnama to attend A.P. Forensic Science Laboratory, Red Hills, Hyderabad, Telangana to give blood samples to conduct DNA profile test and to direct the Director of the said laboratory to submit report. The learned trial Judge through the detailed order impugned in the revision allowed the prayer of respondents 1 to 3. Hence the revision.
Mr.Harinath has challenged the order under revision by pointing out that Smt.Annapurnmma is not one of the parties to the suit and therefore, the scientific study with a person who is not party to the lis cannot and could not be directed. The contention is noted only to be rejected. This Court is of the view that respondents 1 to 3 claim Smt.Annapurnamma as their mother and revision petitioner as their father.
The trial Court has considered the necessity for obtaining DNA report to avoid adducing oral evidence on the disputed relationship between the parties. After going through the detailed
order, I am satisfied that no ground for interference is made out. The revision fails and accordingly dismissed. No order as to costs. Miscellaneous petitions pending, if any, shall stand closed. ___________ S.V.BHATT,J Date:23.03.2017 Stp
