THE HON'BLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.10137 OF 2015 ORDER:

This criminal petition under Section 438 of the Code of Criminal Procedure is filed by the petitioner/A.1 seeking grant of anticipatory bail in crime No.875 of 2014 on the file of the Madhapur Police Station, Cyberabad District, registered for the offence under Section 498-A and Sections 3 and 4 of Dowry Prohibition Act. Heard and perused the records.

Learned counsel for the petitioner submits that the petitioner is in United States of America (USA) and he will come to India in December, 2015 and as such, prays this Court to grant anticipatory bail and also to recall the Non Bailable Warrant (NBW), which is pending against the petitioner/A.1. Considering the facts and circumstances, the petitioner/A.1 is directed to surrender before the Magistrate concerned on or before 30.01.2016 and file an application to recall Non-Bailable Warrant (NBW) issued against him and on such filing, the Court below is directed to recall the NBW on the same day on condition of the petitioner executing a personal bond for a sum of Rs.20,000/- (Rupees twenty thousand only) with one surety to the satisfaction of the Magistrate concerned.

If any Lookout notice is issued by the Authorities concerned, the operation of the same is hereby suspended till 30.01.2016. The petitioner/A.1 is further directed to face the trial either by himself or through his counsel to enable the Court to conclude the trial.
