THE HONOURABLE SRI JUSTICE K.LAKSHMAN W.P. No.1831 of 2020 ORDER:

This writ petition is filed seeking to declare the action of the 2nd respondent, Director of Mines & Geology, in not processing proposals submitted by the 3rd respondent, Assistant Director of Mines and Geology, Warangal, through Lr.No.4216/Q/2011 dated 27.11.2017 for grant of quarry lease for black granite in favour of petitioner firm over an extent of 4.00 hectares in Sy.Nos.497 and 455 situated at Pallariguda village, Sangem Mandal, Khammam District as wholly illegal and arbitrary apart from violation of the guidelines issued by the Government in G.O.Ms.No.181, Industries & Commerce (Mines-I) Department, dated 28.05.1988 and also T.S.

Minor Mineral Concession Rules, 1966 with a consequential direction that the petitioner is entitled for processing the above proposals submitted by the 3rd respondent for grant of quarry lease for black granite in favour of petitioner firm. The limited grievance of the petitioner, in the present writ petition, is that the 2nd respondent, Director of Mines & Geology, is not processing the proposal submitted by the 3rd respondent, Assistant Director of Mines & Geology, through letter dated 27.11.2017.

According to the learned counsel for the petitioner that though the 3rd respondent sent proposals vide letter dated 27.11.2017 to the 2nd respondent, so far, the 2nd respondent is not considering the said proposal. He further submitted that though

the two years of time is lapsed, the 2nd respondent is not taking any further steps pursuant to the said proposal dated 27.11.2017. Learned Government Pleader for Mines and Geology, on instructions, would submit that they will consider the said proposal, in accordance with law.

In view of the above, the 2nd respondent, Director of Mines and Geology, is directed to consider and process the proposal dated 27.11.2017 sent by the 3rd respondent, Assistant Director of Mines and Geology, including the remarks of Tahsildar and other officers concerned, strictly in accordance with law and communicate a copy of the said order to the petitioner and pass appropriate orders within four weeks from the date of receipt of a certified copy of the order.

Accordingly, this writ petition is disposed. There shall be no order as to costs.

As a sequel, miscellaneous applications, if any pending, shall stand closed.
