THE HON'BLE SRI JUSTICE T. VINOD KUMAR Writ Petition No.1820 of 2020 ORDER:
The present writ petition is filed to declare the action of the respondent police in calling the petitioner to police station at the instance of 6th respondent, in interfering civil disputes in connection with the land admeasuring Ac.0.32 guntas, out of Ac.03.20 guntas in Survey No.320 situated at Manuguru Village and Mandal, Bhadradri Kothagudem District without registering any crime, as being illegal, void and opposed to the Articles 14, 19, 21 and 300-A of the Constitution of India.
Heard Sri Mummaneni Srinivasa Rao, learned counsel for the petitioner and the learned Assistant Government Pleader for Home appearing for respondents 1 to 4 and the learned Government Pleader for Social Welfare appearing for 5th respondent and Sri R.R. Kalyan, learned counsel for 6th respondent.
The learned Assistant Government Pleader for Home, on written instructions dated 31.01.2020, while denying the writ averments, submits that respondents 3 and 4 never interfered in the civil disputes between the petitioner and the 6th respondent with regard to the subject land by summoning the petitioner to police station, at any point of time. By the written instructions, it is further stated that the respondent police never summoned the petitioner to the police station on 07.01.2020 as alleged. It is also stated that the petitioner is involved in various criminal cases numbering seven and some of the cases, Calendar Case numbers are given, while in some cases, charge sheets have been filed and the petitioner has also been convicted. It is also stated that the
respondent police authorities except investigating into the cases registered against the petitioner, are not interfering in the civil disputes.
Having regard to the said submissions made on behalf of the official respondents, no further orders need be passed in the matter, except observing that the respondent police authorities shall investigate into the above crimes registered against the petitioner in accordance with law.
Subject to the above observation, the writ petition is closed. Pending miscellaneous petitions, if any, pending in this writ petition shall stand closed in the light of this final order. No order as to costs.
