HON'BLE SRI JUSTICE A. SHANKAR NARAYANA CIVIL MISCELLANEOUS APPEAL No.2388 of 2004 JUDGMENT:

No representation for the appellant. Earlier also, when there was no representation for the appellant, by the order dated 22.08.2014, the Registry was directed to list the matter under the caption 'for dismissal'. On 05.09.2014, on the representation of the learned counsel, Sri Harinath, on behalf of the learned counsel for the appellant then, since submitted that the learned counsel for the appellant was no more, deleted from the caption 'for dismissal' and the Registry was directed to issue notice to the appellant. The Registry has endorsed that the notice was served on the appellant by making a note dated 13.04.2015.

2. Hence, the instant civil miscellaneous appeal is dismissed for non-prosecution. There shall be no order as to costs.

3. As a sequel thereto, miscellaneous applications, if any pending in the instant appeal, stand disposed of.
