THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO CIVIL REVISION PETITION No.2864 of 2015 ORDER:

The petitioner is the plaintiff in O.S.No.119 of 2007 on the file of the learned Junior Civil Judge at Kollapur. The evidence in the suit was completed and it was posted for arguments on 20.01.2015. After taking several adjournments, on 07.04.2015 the petitioner filed an application in I.A.No.66 of 2015 requesting the Court to make local inspection of the suit property and to assess the genuineness of the suit and the suit filed by the wife of the respondent/defendant in O.S.No.77 of 2007 and to take into consideration the documents of both sides and oral evidence of either side in the interest of justice.

The relief sought in the above I.A clearly shows that it was not made for any specific purpose and it does not make any sense also. In those circumstances, the lower Court rightly dismissed the application in I.A.No.66 of 2015 by order dated 03.06.2015. The present Civil Revision Petition is filed challenging the said order. A perusal of the order passed by the lower Court along with the petition filed by the petitioner shows that the lower Court has not committed any irregularity in the exercise of jurisdiction vested in it, and the Civil Revision Petition is liable to be dismissed. The Civil Revision Petition is, accordingly, dismissed. The miscellaneous petitions pending, if any, shall stand closed. There shall be no order as to costs.
