HONOURABLE Dr. JUSTICE B.SIVA SANKARA RAO WRIT PETITION No.1900 OF 2019 ORDER:

This writ petition is filed to declare the action of the 3rd respondent in registering the FIR in Cr.No.14 of 2019 of Chandanagar Police Station, Chandanagar, Rangareddy District, Hyderabad as illegal and arbitrary and to direct the 3rd respondent to follow the procedure under Section 41-A Cr.P.C. before arresting petitioners in connection with the said crime.

Heard learned counsel for the petitioners and learned Public Prosecutor appearing for the State, before ordering notice to respondent No.4/ de facto complainant and perused the grounds in the writ petition. On perusal of the F.I.R., there is nothing to interdict the investigation.

Having regard to the above, the Writ Petition is disposed of, directing the police to proceed with the investigation and in the event of any necessity of arrest of the petitioners, they have to follow Section 41-A Cr.P.C. and the guidelines of the Apex Court as laid down in Arnesh Kumar v. State of Bihar1, strictly.
