THE HON'BLE SRI JUSTICE T.SUNIL CHOWDARY CRIMINAL REVISION CASE No.1803 OF 2012 ORDER:

1 This Criminal Revision Case is filed under Sections 397 and 401 of Cr.P.C challenging the order dated 27.08.2012 passed in Crl.M.P.No.1223 of 2012 in C.C.No.292 of 2011 on the file of the Court of the Judicial Magistrate of I Class, Special Mobile Court, Eluru of West Godavari district.

2 At the time of arguments, the learned counsel for the petitioners has sought permission of the Court to permit the petitioners to withdraw this case, with liberty to avail the remedies available to them under law. He further requested that the presence of the petitioners / A.2 and A.3 before the trial Court may be dispensed with on each and every date of adjournment. There is no dispute with the regard to the identity of the petitioners, who are accused Nos.2 and 3 in the case. Even if the presence of the petitioners / A.2 and A.3 is dispensed with, no prejudice will be caused to the 2nd respondent. 4 In the result, the Criminal Revision Case is dismissed, granting the liberty as prayed for. The presence of the petitioners who are accused Nos.2 and 3 in C.C.No.

292 of 2011 on the file of the Court of the Judicial Magistrate of I Class, Special Mobile Court, Eluru of West Godavari district is dispensed with on each and every date of adjournment. However, they shall appear before the trial Court as and when their presence is so required. As a sequel, the miscellaneous petitions, pending if any in this Criminal Revision Case, shall stand closed.
