THE HON'BLE DR.JUSTICE SHAMEEM AKTHER CRIMINAL PETITION NO.9664 OF 2015 ORDER:

This petition is filed by the petitioners under Section 482 Cr.P.C. to quash the proceedings in C.C.No.749 of 2014 on the file of the Special Judl. Magistrate of I Class (for Prohibiton & Excise Offences) Nalgonda, wherein cognizance was taken for the offences punishable under Sections 138 and 142 of the N.I. Act and 420 IPC.

Heard learned counsel for the petitioners-A1 to A8, A10 and A11, learned Assistant Public Prosecutor representing the 1st respondent-State, learned counsel for the 2nd respondent and perused the record.

Learned counsel for the 2nd respondent would submit that this Court was pleased to pass an order, dated 14.10.2015 admitting the petition in respect of petitioners-A4 to 8, A10 and A11 and dismissing the same in respect of petitioners-A1 to A3. He further submits that in view of the order, dated 14.10.2015, the Court below had stopped all the proceedings in the impugned C.C. He further submits that the 2nd respondent/complainant is ready to proceed against the petitioners A1 to A3 only. Petitioners-A4 to A8, A10 and A11 are only members of Swami Ramanadha Tirtha Educational Society. They are not signatories to the cheque.

In view of the submissions made on behalf of the 2nd respondent, Criminal Petition is allowed quashing the proceedings in C.C.No.749 of 2014 on the file of the Special Judl. Magistrate of I Class (for Prohibiton & Excise Offences) Nalgonda, pending against the petitioners-A4 to A8, A10 and

A11. The trial Court is directed to proceed against the other accused.

With the above direction/finding, the Criminal Petition is disposed of. Miscellaneous petitions, if any pending in this Criminal Petition shall stand closed. ___________________________ DR.SHAMEEM AKTHER, J DATED: 16-03-2018.
