OFFI CE NOTE 24.04.2025 JSR,J I.A.No.2 of 2025 This application is filed invoking the provisions of Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short, 'BNSS') seeking for relaxation of the condition imposed by this Court while granting anticipatory bail to the petitioners/accused Nos.1 and 2 in Criminal Petition No.842 of vide order dated 07.02.2025.

Heard Mr.K.Saibabu, learned counsel for the petitioners and Mr.Syed Yasar Mamoon, learned Additional Public Prosecutor appearing on behalf of respondent-State.

Learned counsel for the petitioners submitted that the petitioners are accused Nos.1 and 2 in Crime No.396 of 2024 of Habeebnagar Police Station, Hyderabad and they approached this Court and filed Criminal Petition No.842 of 2025 seeking anticipatory bail and this Court granted anticipatory bail vide order dated 07.02.2025 with certain conditions. The petitioners complied with all the conditions and they are appearing before the Investigating Officer on every Monday between 9-00 a.m. and 5-00 p.m. till date. However, the

OFFI CE NOTE Investigating Officer has not filed the charge sheet till date. Petitioner No.1 is aged about 70 years and he is a retired Government employee and petitioner No.2 is doing private job and therefore, the petitioner Nos.1 and 2 are facing difficulty to attend before the Investigating Officer on every Monday and the entire investigation is completed except filing of charge sheet. Therefore, the presence of the petitioners before the Investigating Officer is not required. Unless the said condition is relaxed, the petitioners will be put to great hardship.

Learned Additional Public Prosecutor has not opposed for the same.

In view of the reasons mentioned in the application and in view of the submissions made by the learned counsel for the petitioners, the condition imposed against the petitioners in para No.6(iii) in the order passed by this Court in Criminal Petition No.842 of 2025 vide order dated 07.02.2025 is relaxed.

Accordingly, this application is allowed.
