ORDER

Heard learned counsel appearing for the petitioner and learned Government Pleader appearing for respondents 1 to 4. None appeared for the 5th respondent in spite of service of notice. Challenging registration of Cr.No.127 of 2016 by the 4th respondent, the present writ petition is filed. The petitioner and the 5th respondent are advocates. The 5th respondent lodged a complaint against the petitioner alleging violation of provisions of the Scheduled Castes & Scheduled Tribes (Prevention of Atrocities) Amendment Act, 2015 (for short "the Act") in connection with an incident that took place on 24.11.2016 in the Court premises. On a perusal of the entire complaint, this Court is of the opinion that the crime requires investigation and that except abusing the 5th respondent mentioning his caste name, no specific instances were mentioned, warranting arrest of the petitioner under the provisions of the Act.

Accordingly, the Writ Petition is disposed of giving liberty to the Investigating Officer to investigate the crime and file a final report/charge sheet in accordance with law, without arresting the petitioner. If the arrest of the petitioner is warranted, appropriate orders shall be obtained from the Magistrate concerned. No costs.
