THE HONOURABLE SRI JUSTICE K.SURENDER CRIMINAL PETITION NO.906 OF 2024 ORDER:

This Criminal Petition is filed under Sections 437 and 439 of Code of Criminal Procedure, 1973 (for short "Cr.P.C") seeking regular bail to the petitioners/Accused Nos.2 & 3 in SC.NDPS.No.58 of 2023 on the file of I Additional District and Sessions Judge-Cum-Metropolitan Sessions Judge Medchal-Malkajgiri District, registered for the offence under Section 20 (b) (ii) (C) of the Narcotic Drugs and Psychotropic Substances Act, 1985 (for short 'the NPDS Act').

Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the respondent-State and perused the record.

The case of the prosecution is that the Police, Medchal apprehended these petitioners along with others and seized 20.120 kgs. of ganja from them. The seizure was made on 25.09.2022.

Keeping in view that total contraband seized is from four persons, this Court is of the view that relief of regular bail can be considered since the petitioners are in jail from 25.09.2022, subject to following conditions:

i) The petitioners/Accused Nos.2 & 3 shall execute personal bond for a sum of Rs.50,000/- (Rupees Fifty thousand only) with two sureties i.e., one local surety and the other from native place, for a like sum each to the satisfaction of IX Additional Magistrate, Cyberabad at Medchal.

ii) The petitioners/Accused Nos.2 & 3 after release shall appear before the concerned Court on every date of hearing.

iii) The petitioners/Accused Nos.2 & 3 shall abide by the other conditions stipulated under Section 437(3) of Cr.P.C.

Accordingly, this Criminal Petition is allowed.

Miscellaneous applications, pending if any, shall stand closed.
