THE HON'BLE DR.JUSTICE SHAMEEM AKTHER CRIMINAL PETITION NO.1004 OF 2018 ORDER:

This petition is filed by the petitioner-complainant under Section 482 Cr.P.C. seeking a direction to expedite the proceedings in C.C. No.496 of 2015 on the file of the Additional Judicial Magistrate of First Class, Addanki, Prakasam District registered for the offence punishable under Section 138 of the Negotiable Instruments Act, 1881. 2.

Heard the learned counsel for the petitioner, learned Assistant Public Prosecutor representing the State and perused the record.

In the course of submissions, it has been brought to the notice of this Court that originally the proceedings in the aforesaid C.C. were initiated in the year 2013 and thereafter it was transferred to the present Court on the point of jurisdiction, and that examination of the accused is not completed in the said C.C. It is fundamental right of the petitioner-complainant to seek speedy trial and expeditious remedy. As the criminal proceedings were instituted in the year 2013, certainly, pendency of the case would cause hardship to the petitioner/complainant. Under these circumstances, the learned Additional Judicial Magistrate of First Class, Addanki, Prakasam district is directed to dispose of C.C. No.496 of 2015 within a period of 3 months from the date of receipt of a copy of this order.

The Criminal Petition is disposed of with the above direction. Miscellaneous Petitions pending, if any, in this Criminal Petition shall stand closed.
