THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.35725 OF 2016 ORDER:

This writ petition is filed seeking to declare the action of respondents 1 to 4 in not taking any action on the petitioner's representation, dated 19.09.2016, wherein they mentioned to take legal action against the accused, as arbitrary and illegal. 2.

Heard and perused the material available on record. 3.

Learned counsel for the petitioner submits that the petitioner submitted a representation on 19.09.2016, wherein it is stated that some unknown persons sending abusive message and also calling over phone and threatening him dire consequences 4.

Heard the arguments and perused the material available on record. The record discloses that the 4th respondent has given acknowledgment about receipt of representation of the petitioner. Therefore, the 4th respondent has to take appropriate action. 5.

Considering the facts and circumstances of the case and submission of learned counsel for the petitioner, without expressing any opinion on merits, if respondent No.4 is of the view that the complaint discloses an offence which is cognizable in nature, he shall register the same and complete the investigation. If the 4th respondent refuses to register the complaint, the petitioner is at liberty to proceed in accordance with law. 6.
