No representation for petitioner.

Heard the Assistant Government Pleader and Mr.Sriharinath. The petitioner has impleaded Sub Inspector of Police, Shankarampet Police Station in his personal capacity. The petitioner prays for Mandamus declaring the action of 3rd respondent in harassing and threatening petitioner with dire consequences if Crime No.26/ 2013 is not withdrawn, as arbitrary, amounts to colourable exercise of power and unconstitutional. The Assistant Government Pleader (Home) places on record written instructions dated 24.05.2013. The writ petition was filed on 29.04.2013. According to 3rd respondent, on 27.04.2013, the 3rd respondent called upon the petitioner to produce relevant documents for investigation of Crime No.26/ 2013 which was registered under Sections 420,468 and 506 of IPC. The petitioner did not produce the documents.

On the other hand, the present petition is filed. It is further stated Crime No.26/ 2013 has been referred as false. Notice was served on the petitioner and report was filed on 06.05.2013 before the Hon'ble JFCM Court, Medak. After perusing the averments in the writ affidavit and the written instructions, I am satisfied that the writ prayer need not be perused further. The writ petition is dismissed accordingly. No order as to costs.
