THE HON'BLE SRI JUSTICE P.NAVEEN RAO WRIT PETITION No.28661 OF 2015 ORDER:

The petitioner claims to be the owner of MIG Plot No.42, Bathukammakunta, Bagh Amberpet, Hyderabad. The petitioner filed building permissin application on 06.12.2014 enclosing necessary documents and also paying necessary fee. The grievance of the petitioner necessitating institution of this writ petition is that the building permission application is not disposed of and no orders are passed on the building permission application without any justification.

2. Learned counsel for the petitioner contends that on the ground that orders are passed by this Court in W.P.No.22184 of 2009, no building permission was granted, but the said order was reviewed by this Court in Review W.P.M.P.No.31741 of 2014 in W.P.No.11681 of 2000 on 21.08.2014. Thus, learned counsel for the petitioner submits that the building permission application ought to have been considered duly taking note of the orders passed by this Court in Review W.P.M.P.No.31741 of 2014 in W.P.No.11681 of 2000.

3. Having regard to the submissions made, without expressing any opinion on merits, the Writ Petition is disposed of directing the respondent - Municipal Corporation to consider the building permission application submitted on 06.12.2014 duly taking note of the orders passed by this Court in Review W.P.M.P.No.31741 of 2014 in W.P.No.11681 of 2000 and pass appropriate orders as warranted by law within a period of eight (8) weeks from the date of receipt of a copy of this order. There shall be no order as to costs.

4. Consequently, Miscellaneous Petitions, if any, pending in this Writ Petition, shall stand closed.
