442 of 2002 on the file of the learned Chairman of the Motor Accidents Claims Tribunal-cum-Prl.District Judge, Medak, at Sangareddy (for short, 'Tribunal'), filed under Section 166 of the Motor Vehicle Act,1988 (for short, 'the Act'), for the claim filed by the wife-1st petitioner, sons(two major and one minor)-petitioners 2 to 4 and two minor daughters-petitioners 5 and 6 of the deceased Mohammad Abdul Samad, aged about 50years, who died in the accident while proceeding on his Luna bearing No.AIX 8891 caused by the crime lorry bearing No.AP 31 U 2526 belongs to the 1st respondent of claim petition insured with the 2nd respondent covered by Ex.B.1 policy, for Rs.6,00,000/- since awarded of Rs.3,99,491/- with interest at 9% p.a.
by fixing joint liability, with the contentions in the grounds of appeal that the quantum is excessive and exorbitant and the tribunal erroneously concluded the same and the same is unsustainable and against the settled principles and thereby set aside the award by allowing the appeal. The learned counsel for the appellant-Insurer reiterated the same during course of hearing and further submitted that the claimants 2 and 3 are no way dependents on the deceased among the 6 claimants and it is also the contention that there is a contributory negligence on the part of the deceased at the time of the accident and the rate of interest is excessive to reduce. 2.
Whereas, it is the contention of the learned counsel for the claimants that there is nothing to interfere with the award of the tribunal for this Court while sitting in appeal, hence to dismiss the appeal but for no cross-objections to enhance. 3. Perused the material on record. The parties hereinafter are referred to as they were arrayed before the Tribunal for the sake of convenience in the appeal. 4. Now the points that arise for consideration in the appeal are: Whether the compensation awarded by the tribunal is excessive and exorbitant so also the rate of interest and there is any contributory negligence on the apart of the deceased, if so, this Court requires interference while sitting in the appeal and with what observations? To what result? Point No.1: 5.
The accident was occurred while the deceased was proceeding on his Luna bearing No.AIX 8891 while the crime vehicle of the 1st respondent was proceeding from behind, it clearly shows that there is nothing contributory negligence on the part of the deceased as rightly concluded by the tribunal. 6. Now coming to the quantum of compensation and rate of interest as excessive is concerned, the deceased was aged about 50 years as on the date of accident i.e. on 14.07.2002 and as per the Ex.A.4 salary certificate record, the deceased was worked as Attender in Mandal Parishad Development Office and drawn monthly salary of Rs.6,258/- and after deducting professional tax etc., with 15% increase towards prospective earnings therefrom as per Rajesh v. Rajbir Singh, the monthly earnings of the deceased to be taken as Rs.
6900/-, out of the 6 claimants, even claimants 2 and 3 are majors not dependents, among the remaining 4 dependants are wife and three minor children. As per Sarla Verma v. Delhi Transport Corporation where the dependants are 4 to 6, 1⁄4 to be deducted towards personal expenses, if 1⁄4 deducted towards personal expenses, it is of Rs.5175/-x12x13(multiplier since the deceased is aged about 50 years at the time of accident as per Sarla Verma supra), it comes to Rs.8,07,300/-. Thus, what the tribunal awarded of Rs.3,99,491/- is no way excessive but for no cross-objections to increase. Thus in the factual matrix, this Court is not inclined to exercise the discretion but for to reduce the interest from 9% to 7.5% p.m. which is just as per as per Rajesh (supra). Accordingly, Point No.1 is answered. Point No.2: 7.
In the result, appeal is dismissed with no costs. Consequently, miscellaneous petitions, if any pending in this appeal, shall stand closed. _______________________ Dr. B.
