THE HON'BLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.8297 of 2016 ORDER:

This Criminal Petition is filed by the petitioner/A-2 under Sections 437 & 439 Cr.P.C., seeking bail in Crime No.222 of 2015-16, on the file of Prohibition & Excise Police Station, Prathipadu, East Godavari District, registered for the offences punishable under Section 8(c) read with 20(b)(ii) of NDPS Act, 1985.

Heard and perused the material available on record. The allegation against the petitioner is that A-1 and A-2 are found in possession of 68 kgs of dry ganja.

Since the ganja seized from the possession of A-1 & A-2 is commercial quantity, this Court is not inclined to grant bail to the petitioner/A-2.

Hence, the Criminal Petition is dismissed.
