THE HON'BLE SRI JUSTICE K.SURENDER CRIMINAL PETITION NO.978 OF 2024 ORDER:

This Criminal Petition is filed under Section 438 of Cr.P.C. by the petitioners - accused Nos.1 and 3 seeking anticipatory bail in the event of their arrest in connection with Crime No.95 of 2023 on the file of Station House Officer, Garla Bayyaram Police Station, Mahabubabad District, registered for the offences punishable under Sections 143, 290, 506, 447 and 436 read with Section 149 of the Indian Penal Code (for short 'IPC') and Sections 3(1)(r)(s) and 3(2)(va) of SC/ST (POA) Act.

Heard learned counsel for the petitioners and learned Additional Public Prosecutor for respondent No.1 - State and perused the record.

This Court, by order dated 16.08.2023 in Crl.P.No.7449 of 2023 refused the prayer of anticipatory bail to petitioner No.1 - accused No.1. There are no changed circumstances, accordingly, the relief of anticipatory bail for petitioner No.1 - accused No.1 is dismissed.

However, this Court had granted the relief of anticipatory bail to accused Nos.2, 4, 5, 7 to 10, 12 and 13 in Crl.P.No.7449 of 2023. Since the petitioner No.2 who is accused No.3 stands on the same footing, this Court is inclined to extend the relief of anticipatory bail to petitioner No.2 - accused No.3 on the following conditions: i) Petitioner No.2 - accused No.3 is directed to surrender before the Station House Officer, Garla Bayyaram Police Station, Mahabubabad District on or before 05.02.2024. On such surrender, the said Station House Officer shall release him on bail, on his executing personal bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties for a like sum each to his satisfaction.

ii) On such release, the petitioner No.2 - accused No.3 shall appear before the said Station House Officer, as and when directed for the purpose of investigation. iii) Petitioner No.2 - accused No.3 shall abide by the other conditions stipulated in Section 438(2) of Cr.P.C and shall cooperate with the Investigating Officer in investigating the case.

Accordingly, this Criminal Petition is partly allowed. Miscellaneous applications, if any pending in this criminal petition, shall stand closed.
