HONOURABLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.1896 of 2019 ORDER:

The grievance of the petitioner is with regard to the erection of a cell tower on what is stated to be Government land in Survey No.581 of Pudur Village, Medchal Mandal, Medchal-Malkajgiri District. He seeks a consequential direction to the Panchayat Secretary/Executive Officer of Pudur Gram Panchayat, Pudur Village, Medchal Mandal, Medchal-Malkajgiri District, to cancel the permission granted under proceedings dated 27.7.2018. Perusal of the affidavit filed in support of the Writ Petition does not demonstrate as to how the petitioner claims any personal grievance in relation to the subject erection. He merely stated that he is a resident of Pudur Village and owns a house nearby the area where the cell tower is proposed to be erected. This statement, by itself, does not constitute sufficient cause of action for the petitioner to maintain this Writ Petition as framed. If the petitioner seeks to act in public interest, he must profess to do so. However, there is no such statement made in the writ affidavit.

The Writ Petition is accordingly dismissed. This order shall however not preclude the petitioner from filing a public interest litigation, if he so chooses.

Pending Miscellaneous Petitions, if any, shall also stand dismissed. No order as to costs.
