THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.1927 of 2019 ORDER:

The grievance of the petitioner is that the Tahsildar, Palakurthi Mandal, Palakurthi, Peddapally District, is not taking action upon his application dated 27.04.2018, whereby he sought mutation of his name in the revenue records in relation to the land admeasuring Acs.8.14 guntas in Survey No.361 and Acs.9.26 guntas in Survey No.368 of Palakurthi Village, Palakurthi Mandal, Peddapally District, which was inherited by him from his ancestors. Perusal of the record reflects that the petitioner merely submitted a written application in this regard without following the procedure prescribed under the Telangana Rights in Land and Pattadar Passbooks Act, 1971. The said enactment requires submission of an application in Form VI(A) along with the requisite fee for this purpose. Without submitting an application as per the prescribed procedure, it is not open to the petitioner to complain of inaction on the part of the revenue authorities.

The writ petition is accordingly disposed of leaving it open to the petitioner to submit an application in the prescribed format along with the requisite fee, if he so chooses. In the event such an application is made, the Tahsildar, Palakurthi Mandal, Palakurthi, Peddapally District, shall take necessary action thereon in accordance with the due procedure expeditiously and in any event, not later than four weeks from the date of its receipt. Pending miscellaneous petitions, if any, shall stand closed in the light of this final order. No order as to costs.
