This Criminal Petition is filed under Section 52g of Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023 seeking to quash the proceedings against the petitioner/accused No.4 in C.C.No.1717 of 2025, ot the file of the learned Xll Additional Chief Judicial Magistratr: at Hyderabad, registered for the offences punishable under Ser:tions 406 and 420 read with 34 of lpC. 2.
Heard Mr.Syed Musab Rahim Hashmi, learned counsel for the petitioner/accused No.4 as well as Sri Jitender Rao Veeramalla, the learned Additional Public Prosecutor appearing for the respondent No.1-Stak;.

Learned petitioners' counsel submitted that the petitioner herein is the sister of accused No.1 and that she is not at all concerned with the alleged offences and that there is no truth in the allegations and the contents of the complaint themselves are self-contradictory in nature. He further submitted that the petitioner herein is innocent and is not concerned with the alleged offences. He therefore prayed to quash the proceedings against the petitioner. 4.
The learned Additional Public Prosecutor has submitted that the petitioner being sister of accused No.1, has received the amounts from the alleged victims and that the petition lacks merits and therefore prayed to dismiss the same.

Perused the record. lt is alleged that accused No-1 has registered Proprietorship firm in the name of accused No.3 and asked the de facto complainant and others to transfer their amounts to accused Nos.2 & 3 accounts and also to the account of his sister accused No.4. The recitals of charge sheet further point out that on verification of account statement, it was revealed that Rs.11,07,0001' was transferred from the alleged victims i.e., from LWs 3 to 10 to the account of accused No.4. The petitioner herein is accused No.4. Sinc€ tfrere are specific allegations pointing out the said offences
against the petitioner herein, the proceedings cannot be quashed. However, in the facts and circumstances of the case, it is deemed appropriate to dispose of the Criminal Petition by dispensing with the attendanr:e of the petitioner before the Trial Court. 6.
Hence, the Criminal Petition is disposed of dispensing with the presence of the petitioner/accused No.4 before the Trial Court provided that the petitioner is represented through an Advocate on every dale of hearing and that she.shall be present before the Trial Court whenever her presence is specifically required during the course of trial.
