As per the endorsement made by the Registry, the Appeal was dismissed for default against the respondents 2 and 3 by virtue of the order, dated 06.04.2006. No steps were taken by the appellant and in view of the same, in the absence of contesting parties, the Appeal cannot be continued.

The Appeal Suit is accordingly dismissed.

Consequently, miscellaneous petitions pending, if any, shall stand closed. There shall be no order as to costs.
