B.Jayaramudu, v. The State Of A.P.
THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.1557 of 2018 ORDER:
Heard learned counsel for the petitioner and the learned Government Pleader for Revenue appearing for the respondents. 2.
The case of the petitioner is that originally one Smt B.Peddakka was the absolute owner and possessor of land to an extent of Ac.0-30 cents in Survey No.158/2 of Ananthapuram Town, Ananthapuram District. Pattadar passbooks and title deeds were issued in her favour in the year 1995. While so, the petitioner purchased the said land on 16.08.2004 under a registered sale deed and since the date of purchase, he has been in possession of the same. He has been paying vacant land tax to Ananthapuram Municipal Corporation regularly.
One M.Narasimhulu filed O.S.No.210 of 2004 on the file of Additional Senior Civil Judge, Ananthapuram, for declaration of his title over the above land and the said suit is still pending. In that connection when the petitioner took out a copy of the revenue record, he was surprised to know that in Column Nos. 12 and 13 of the Adangal, it was mentioned as 'house sites' in stead of his name. Challenging the action of the third respondent, the present Writ Petition is filed.
3.
This Court is not inclined to entertain the present Writ Petition as the petitioner has a remedy under Section 3 (3) of the A.P. Rights in Land and Pattadar Passbooks Act, 1971, for correction of entries in the revenue records.
4.
In the circumstances, the Writ Petition is disposed of giving liberty to the petitioner to submit an application for correction of entries in the revenue records in respect of land to an extent of Ac.0-30 cents in Survey No.158/2 of Ananthapuram Town, Ananthapuram District, purchased by the petitioner on 16.08.2004 under a registered sale deed and claiming to be in continuous possession since the date of purchase. As and when such an application is filed, it is needless to mention that the third respondent shall dispose of the same, as expeditiously as possible. Miscellaneous petitions, if any, pending in this writ petition shall stand closed. There shall be no order as to costs. ________________________________ A.RAMALINGESWARA RAO, J JANUARY 30, 2018 Note:
