ORDER:
This Criminal Petition is filed under Sec.438 Cr.P.C. seeking anticipatory bail in the event of arrest of the petitioner/accused in FIR No.60 of 2012 on the file of C.I.D. Police Station, Hyderabad, registered for the offences punishable under Sections 468, 471 and 420 IPC read with Section 34 IPC.
The learned counsel for the petitioner submitted that the petitioner did not commit the offences, as alleged by the complainant. Where the investigation is at the threshold, it would be appropriate to permit the prosecution to proceed with the case. However, where it is contended by the petitioner that the contents of the complaint are false, it would be just and reasonable to restrain the police from arresting the petitioner during the pendency of the investigation.
Accordingly, this Criminal Petition is disposed of granting liberty to the Police to proceed with the investigation in Crime No.60 of 2012 of C.I.D. Police Station, Hyderabad. Police, however, are restrained from arresting the petitioner during the pendency of the investigation. The petitioner is at liberty to approach the trial Court regarding the withdrawal of L.O.C. and for any other relief. Miscellaneous Petitions, pending if any in this Criminal Petition, shall stand closed.
