THE HON'BLE SRI JUSTICE SANJAY KUMAR CIVIL REVISION PETITION No.1959 OF 2016 ORDER:
The plaintiff in O.S.No.215 of 2011 on the file of the learned Additional Junior Civil Judge-cum-XVIII Metropolitan Magistrate, Cyberabad, is the petitioner. He filed the present civil revision petition under Article 227 of the Constitution aggrieved by the denial of a temporary injunction by the trial Court under order dated 24.11.2011 passed in I.A.No.1179 of 2011 in O.S.No.215 of 2011 which was confirmed in appeal by the learned XVI Additional District and Sessions Judge, Ranga Reddy District, at Malkajgiri, in C.M.A.No.48 of 2013 under order dated 27.01.2016.
It is however stated by the learned counsel for the petitioner/plaintiff that there was no stay of further proceedings in the suit and the suit has progressed to the stage of trial. That being so, this Court is of the opinion that no further intervention is called for at the interlocutory stage and that the petitioner/plaintiff may pursue his main remedy in the suit. That apart, perusal of the orders under revision reflects that no cause is made out for interference with the concurrent findings of the courts below.
The civil revision petition is accordingly dismissed. The trial Court shall endeavour to dispose of the suit as expeditiously as possible.
Pending miscellaneous petitions, if any, shall also stand dismissed. No order as to costs.
