HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No.2035 of 2019 ORDER:

When the matter is taken up for hearing, it is noticed that the petitioner has retired from service on 31.01.2019. Learned counsel for petitioner has contended that the respondents ought to have referred the case of the petitioner to the Medical Board in the year 2017 itself for appropriate assessment of his health condition, but the respondents have not done so. Therefore, the petitioner has filed the writ petition contending that his case be referred to the Medical Board for medical assessment as on 21.12.2017. He further contends that atleast now the case of the petitioner be referred to the Medical Board to assess his health condition prevailing as on 21.12.2017 and prays that appropriate orders be passed in the writ petition directing the respondents to refer the case of the petitioner to the Medical Board.

This Court, having considered the submissions made by the learned counsel for the petitioner, is of the considered view that the relief sought for by the petitioner cannot be granted as there is no scientific technology or Medical Board to assess the health condition of the petitioner as on 21.12.2017 i.e., nearly one year prior to filing of this writ petition. Therefore, this Court is not inclined to entertain the writ petition.

The writ petition is accordingly dismissed. No order as to costs. Pending miscellaneous petitions, if any, shall stand closed. ____________________________ ABHINAND KUMAR SHAVILI, J Date:04-02-2019 Prv
