P.B.Srinivas, v. Andhra Bank, Adoni Branch,
THE HON'BLE SRI JUSTICE G.SHYAM PRASAD CIVIL REVISION PETITION No. 2868 OF 2016 ORDER:
This civil revision petition is arising out of order dated 13-04-2016 passed in I.A.No. 389 of 2013 in O.S.No. 65 of 2012 on the file of the Court of Senior Civil Judge, Bobbili (for short, 'the lower Court'). 2.
Learned counsel for the petitioner submits that this petition has been filed to reject receiving of the documents in the suit as they are not relevant for the disposal of the suit. The contention of the petitioner is that none of these documents are executed either the petitioner or the respondent. 3.
The lower Court, after considering the arguments of both parties, has dismissed the petition for rejection of document Nos. 1 to 11 on the ground that they are the documents pertaining to the head office and the branch office where the transaction has taken place and also observed that the documents cannot be rejected at that stage of the suit.
4.
Learned counsel for the petitioner further submits that the said documents were already marked as Exs.A1 to A11 before the lower Court in the suit. In view of the representation of learned counsel for the petitioner that the documents were already marked before the lower Court, the lower Court is hereby directed to consider the relevancy of the documents while considering the merits in the suit.
5.
With this observation, the civil revision petition is disposed of. Pending miscellaneous petitions, if any, in this revision petition shall stand closed in consequence. No order as to costs.
