Common Order:

Company Application No.1357 of 2014 is filed for the following reliefs:

"i) take the affidavit on record;

ii) permit the respondent to get the properties of the Company (in liquidation) situated at Vengalatur Village, Pichatur Mandal, Chittoor District, Andhra Pradesh, to be inventories and value through its own panel valuer or through such other valuer as this Hon'ble Court may deem fit and proper; and iii) That in case this Hon'ble Court is pleased to appoint to any other valuer then professional fee to be paid be fixed and direction be given to the respondent to make payment thereof." Company Application No.1429 of 2014 is filed for the following reliefs:

"i) take cognizance of the offence committed by the accused under Section 454 (5A) of the Companies Act, 1956; ii) summon the accused for being tried and punished in accordance with sub-section (5) of section 454 of the Companies Act, 1956 for having willfully and deliberately not complying with the requirements of sub-sections (1), (2) and (3) of section 454 of the Companies Act, 1956;

iii) dispense with the presence of the complainant during the trial of the above complaint; and iv) order that the costs of this application do come out of the assets of the company."

Today, by a separate Order, this Court has set aside Order, dated 02-07-2014, in CP.No.52 of 2013, whereunder M/s.BVR Paper Industries (India) Private Limited was directed to be wound up, discharging the Official Liquidator. In view of the said Order, these Company Applications have become infructuous and they are, accordingly, dismissed as such.
