THE HON'BLE SRI JUSTI CE A. RAMALI NGESWARA RAO WRI T PETI TI ON NO. 1577 OF 2018 ORDER:

This Writ Petition is field challenging the action of the 1st respondent in trying to evict the petitioners from their lands of an extent of Ac.0.34 cents, Ac.0.32 cents and Ac.0.22 cents situated in Sy.No.47 of Gangavalli village in the limits of Pochavaram Gram Panchayat, Vatsavai Mandal, Krishna district without following due process of law.

Learned Government Pleader produced before this Court, the written instructions issued by the Tahsildar stating that the land of an extent of Ac.8.36 cents in RS.No.47 of Gangavalli village is classified as village site as per the revenue records. Out of the said extent of land, Ac.2.50 cents of land is vacant and proposals were sent for issue of house site pattas to 53 eligible weaker section beneficiaries of the same village. No proclamation was issued in the village as alleged in the affidavit. The petitioners also did not approach the Tahsildar, Vatsavai to prove their title to the land. The proposals were submitted to the higher authorities only after verification of the vacant land on ground for issuance of house site pattas. If the petitioners approach the Tahsildar, title will be verified and action will be taken in accordance with law.

In view of the statement made by the learned GP on the basis of written instructions, this Writ Petition is disposed of giving liberty to the petitioners to approach the Tahsildar and submit the title documents in order to enable the Tahsildar to take action as per law in favour of the petitioners if the petitioners possess any title.

Pending miscellaneous petitions, if any, shall stand closed. No order as to costs.
