THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL REVISION CASE Nos.1193 of 2013, 1575 AND 1576 OF COMMON ORDER:
The three criminal revision cases are arising out of D.V.C.No.53 of 2013 on the file of the III Metropolitan Magistrate, Hyderabad, and as such, three cases are being disposed of by this common order. The Criminal Revision Case No.1193 of 2013 is filed by the petitioner challenging the order, dated 01.06.2013, in Crl.M.P.Nos.504 and 505 of 2013 in D.V.C.No.53 of 2013, whereby the learned trial Judge partly allowed the petition filed by the first respondent herein and directed the petitioner herein to pay an amount of Rs.2,000/- to the petitioner towards rental accommodation and to pay further amount of Rs.5,000/- towards monthly maintenance to the petitioner and her daughter. The Criminal Revision Case Nos.1575 and 1576 of 2015 are filed by the petitioner challenging the common order dated 24.07.2015 in Criminal Appeal Nos.
549 and 550 of 2013 passed by the learned V Additional Metropolitan Sessions Judge (Mahila Court), at Hyderabad, whereby the learned Sessions Judge partly allowed the criminal appeals enhancing the rental accommodation to Rs.3,500/- and interim maintenance of Rs.3,500/- to the petitioner and Rs.3,000/- to the daughter of the petitioner.
Heard and perused the material on record.
When the cases are taken up for hearing, after arguing for some time, the learned counsel for the petitioner confined his arguments with regard to speedy disposal of D.V.C.No.53 of 2013 and prays this Court to direct the Court below to dispose of the case as expeditiously as possible. Taking into consideration the submission of the learned counsel for the petitioner and as the D.V.C., is of the year 2013, the Court below is directed to dispose of the D.V.C.No.53 of 2013 as expeditiously as possible, preferably within a period of four months. Till disposal of the case by the Court below, the petitioner herein is directed to pay rental
accommodation of Rs.2,500/- to the petitioner and to pay Rs.2,500/- to the petitioner and Rs.2,000/- to the daughter of the petitioner towards monthly maintenance. The petitioner is also directed to pay entire arrears of maintenance calculating @ Rs.7,000/- per month on or before 30.09.2015. The trial Court need not be influenced by this order and can pass appropriate orders on merits of the case. With the above directions, the Criminal Revision Cases are disposed of. Consequently, the miscellaneous petitions pending in these revisions, if any, shall stand closed.
