THE HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.22030 OF 2016 ORDER:

Heard the learned counsel for the petitioner; learned Government Pleader for Municipal Administration and Urban Development for respondent No.1 and Sri Pasham Krishna Reddy, learned Standing Counsel for respondents 2 and 3. With their consent, the present Writ Petition is disposed of at the admission stage.

2. The present Writ Petition is filed with the following prayer: "to issue a writ more in the nature of Writ of Mandamus, declaring the action of the Respondent No.2 and 3 in trying to take possession of the land of land bearing municipal No.17-2-605/1, situated at Saidabad, Hyderabad marked under road widening without paying Exgratia or handing over the TDS certificates for Land Acquisition of road as arbitrary, illegal, discriminative, in violation of principles of natural justice, violative of the Fundamental Right guaranteed under Articles 14 and 300-A and the Constitutional Right guaranteed, and contrary to the provision of HMC Act, 1955 and rules made therein and pass such other order or orders as are deemed fit and proper in the circumstances of the case."

3. Today when the matter is taken up for hearing, learned Standing Counsel for Municipality states that TDS Certificates will be handed over within a period of two (02) weeks.

4. Learned counsel for the petitioner submits that since the petitioner made a representation to the authorities on 09.07.2016, the same may also be directed to be considered.

5. Having regard to the above, the Writ Petition is disposed of directing the respondent authorities to hand over the TDS

Certificates to the petitioner within a period of two (02) weeks from today and also consider the representation said to have been made by the petitioner, if the same is received by the authorities concerned, in accordance with law.
