On the previous occasion, when the matter was listed on 16.08.2016, this Court at the request of the learned counsel for the petitioner as well as the learned Government Pleader, adjourned the matter and directed the matter to be listed after one week finally. This Court also observed that no further adjournment would be granted. Despite the same, no instructions could be received from the learned counsel for the petitioner. 2.

It is also important to note that a counter affidavit deposed by the Executive Engineer (R&B) National Highways, Division, Kakinada, East Godavari District is filed and at paragraph No.4 of the counter affidavit it is stated that pursuant to the communication from the office of the learned Advocate General, Andhra Pradesh, he verified the record in respect of Atlanta Limited/petitioner herein and as per the record available in the office, the Bank Guarantee was renewed up to the period 30.06.2008 and the subsequent record is not traceable. It is also submitted by the learned Government Pleader that the respondent did not renew the bank guarantee also.

In view of the above, at this length of time, nothing obviously survives for adjudication in the writ petition as the apprehension of the petitioner was stated to be incorrect. In view of the same, writ petition is closed. However, it is open for the respondents to take steps in accordance with law. As a sequel, pending miscellaneous petitions, if any, shall stand closed.
