THE HON'BLE SRI JUSTI CE SANJAY KUMAR AND THE HON'BLE MS. JUSTI CE J. UMA DEVI WRI T PETI TI ON No.24137 of 2013 ORDER: (per Justice Sanjay Kumar) Sri T.D.Phani Kumar, learned counsel for the petitioners, states that in the light of the One Time Settlement offered by the State Bank of India, the petitioners do not wish to pursue this writ petition. Sri Maruthi Jadhav, learned counsel representing Sri B.S.Prasad, learned counsel for the respondent bank, would state that he has no such instructions from his client and that he has been asked to argue the matter on merits.
However, as the petitioners are no longer desirous of prosecuting the writ petition, we are of the opinion that they cannot be compelled to do so.
The writ petition is accordingly dismissed recording the statement of Sri T.D.Phani Kumar, learned counsel, that no further orders are required to be passed therein.
Interim order dated 19.08.2013 shall stand vacated. Pending miscellaneous petitions, if any, shall also stand dismissed. No order as to costs.
