THE HON'BLE SRI JUSTICE S.V.BHATT WRIT PETITION No.46600 of 2016 ORDER:

Petitioners complain inaction in considering and disposing of application dated 23-02-2015 by 4th respondent as illegal, arbitrary and unconstitutional.

Sri Cheemalapati Ravi representing 4th respondent, on instructions, submits that the application dated 23-02-2015 is not filed in the form prescribed for grant of building/ construction permission. Therefore, the inaction complained in the writ petition is without substance.

I have perused the material available on record and I am satisfied that the writ petition can be disposed of by this order. The petitioners are given liberty to apply in the prescribed form before the 4th respondent for construction of Lakshminarayana Swamy Temple in an extent of Ac.0-50 cents in Sy.No.92/ 3 of K.Errampalem Village, Rampachodavaram Mandal, Fokspet Grampanchayat, East Godavari District, by enclosing a copy of this order. The 4th respondent is directed to examine the application, process the same in accordance with extant rules and take a decision within six weeks from the date of receipt of application.

The writ petition is disposed of accordingly. As a sequel, the miscellaneous applications, if any pending, shall stand closed. There shall be no order as to costs.
