Kanukula Tirupathi Reddy v. State Of Telangana
THE HONOURABLE SRI JUSTICE A.V.SESHA SAI WRIT PETITION No.1742 of 2018 Heard learned counsel for the petitioner and the learned Government Pleader for Home (Telangana).
When the matter is taken up, learned Government Pleader for Home has placed on record the written instructions, dated 25.01.2018, furnished by the Sub-Inspector of Police, Bowenpally Police Station, Hyderabad. The said instructions read as under:
"One Mr.K.Kaldas Reddy, son of late K.Ganga Reddy, aged about 70 years, Occ.Business, resident of Sikh Village, Secunderabad has approached the police of Bowenpally Police Station, Hyderabad and lodged a complaint on 20.11.2017 requesting to initiate action against Mr.K.Tirupathi Reddy, K.Uppa Reddy and K.Vijayalaxmi as they have taken amounts in total Rs.7,00,000/-for registration of mortgage deed dt.8.5.2017 in respect of Flat No.404, 4th floor, bearing Sy.No.199/Part, situated at Thokatta village by depositing original gift settlement with Mr.K.Tirupathi Reddy and cheated him and evading the payment. Upon receipt of the said complaint, an entry was made into the Station General on 20.11.2017, after enquiry action will be taken.
To know the veracity in the contents of the above complaint, this respondent police tried to contact the petitioner but he did not turned up till date. No case whatsoever was registered till date on the said complaint against the petitioner herein. Since the dispute is civil in nature, no case was registered and accordingly, the said petition is closed.
It is submitted that on coming to know the lodging of the complaint by Mr.K.Kalidas Reddy (7th respondent herein), the petitioner to prevent the police from taking any action in the event of registration of any case against him, rushed to this Hon'ble Court and filed the present writ petition on mere apprehension without any cause of action.
I humbly submit that this respondent never interfered with the civil litigations not tortured or harassed the petitioner as alleged. I humbly submit that having bore grudge against the 7th respondent, the petitioner filed the present writ petition".
Eventually a request is made by the learned counsel for the petitioner to place the above written instructions on record and dispose of the Writ Petition.
Accordingly, the Writ Petition is disposed of, by placing on record the above written instructions.
As a sequel thereto, miscellaneous petitions, if any, shall stand closed. There shall be no order as to costs. ________________ A.V.SESHA SAI 30th January, 2018.
