O R D E R

This Criminal Petition is filed before this Court for grant of bail to the Petitioner who is arrayed as accused No.8 in PRC No.10 of 2019 in Crime No.51 of 2016 of Kushaiguda Police Station, Secunderabad, registered for the offences punishable under Sections 452, 364A r/w 149 of the IPC.

The brief facts of the case are that, on 25-01-2016, the Sub Inspector of Police, Kushaiguda received a complaint from

- 2 - complainant stating that the complainant is residing as a tenant in the house of Smt. Vempati Kameswari. On 25-01-2026, the complainant heard some noise from upstairs portion wherein one Balakrishna Rao is residing. The complainant got up and noticed about 10 persons forcibly taking away Balakrishna Rao and pushed him into the safari and kidnapped him. Balakrishna Rao was shouting to save him. Immediately, the complainant called 100 and after 15 minutes kushaiguda police visited the spot and the complainant went to upstairs and found door lock broke opened. Hence, the complainant requested to take necessary action. Basing on the said complaint, the police registered a case for the above said offences.

Heard Sri Vijay Kumar, learned counsel appearing on behalf of the petitioner as well as Sri M. Vivekananda Reddy, learned Assistant Public Prosecutor for respondent-State. 4.

Learned counsel for the petitioner submitted that the petitioner herein is arrayed as accused No.8 and other accused Nos.1 to 7 were already found not guilty and were acquitted in SC.No.754 of 2018 and the petitioner herein is unaware of the pending proceedings against him in PRC and he is in jail since 19.11.2025 and there is no progress in the SC. It is further submitted that accused Nos.1 to 7 were already acquitted and accused No.9 was discharged by the trial Court and he is ready to

- 3 - cooperate with the trial Court. Therefore, he prayed the Court to grant bail to him by allowing this criminal petition. 5.

On the other hand, learned Assistant Public Prosecutor opposed the submissions made by the learned counsel for the petitioner stating that the case of the petitioner herein is still pending before the trial Court and if he is released on bail, he will not attend before the trial Court. Therefore, he prayed the Court to dismiss the criminal petition.

In the light of the submissions made by both the learned counsel and upon perusal of the material available on record, it appears that the petitioner is in jail since 19.11.2025 and as on today, the said PRC was not concluded by the Sessions Court. According to the learned counsel for the petitioner and also learned Assistant Public Prosecutor, accused Nos.1 to 7 were already acquitted and accused No.9 was discharged by the trial Court. Considering the facts and circumstances of the case, the nature of the allegations, the stage of investigation, the duration of incarceration, this Court finds it appropriate to grant bail to the petitioner, subject to the following conditions: i.

The petitioner shall execute a personal bond for a sum of Rs.25,000/- (Rupees

- 4 - Twenty Five Thousand only), with two sureties for a like sum each to the satisfaction of the learned II Additional District and Sessions Judge.

ii.

The petitioner shall appear before the concerned SHO at 11:00 a.m., on every Monday for a period of eight (8) weeks or till filing of charge sheet whichever is earlier, for the purpose of investigation, and thereafter, as and when required.

iii.

The petitioner shall abide by the conditions stipulated in Section 437(3) of Cr.P.C. (presently, Section 480(3) of the BNSS).

iv.

The petitioner shall attend the trial Court on every date of adjournment.

Accordingly, the Criminal petition is allowed. Miscellaneous applications, if any pending, shall stand closed.
