Heard the counsel for petitioner.

The petitioner has filed the present Civil Revision Petition assailing the order dt.13.01.2017 passed in I.A.No.145 of 2017 in O.S.No.41 of 2017 on the file of Senior Civil Judge, Bhimavaram. 3.

The said application has been filed by the 1st respondent for an ad interim injunction restraining the petitioner and other defendants from proceeding with digging or any other form for converting Acqua ponds of their lands which form the Eastern Boundary to the plaint schedule land pending disposal of the suit.

The Court below granted the order of status quo until further orders on 13.02.2017.

The counsel for petitioner contends that the petitioner had obtained an order on 25.01.2017 in WPMP.No.2904 of 2017 in WP.No.2479 of 2017, restraining the State and other State Government Officials from interfering with his digging operations for fishing in prawn tanks; and that he has filed a counter-affidavit in the said I.A., but the matter is being adjourned from time to time and is not being taken up.

Having regard to the submission of the counsel for petitioner, the Senior Civil Judge, Bhimavaram is directed to decide I.A.No.145

MSR,J crp_2978_2017 ::2::

of 2017 in O.S.No.41 of 2017 on his file within a period of three (03) weeks from the date of receipt of a copy of the order, after hearing the counsel for petitioner herein as well as the 1st respondent herein and other defendant.

Accordingly, the Civil Revision Petition is disposed of with the above directions. No order as to costs.

As a sequel, miscellaneous petitions pending if any in this Civil Revision Petition, shall stand closed.
