ORDER
This Criminal Petition is filed under Section 482 of Bharatiya Nagarik Suraksha Sanhita, 2023 (for short 'BNSS') for grant of pre-arrest bail to the petitioners, who arrayed as accused Nos.2 and 3 in Crime No.555 of 2025 before the Balapur Police Station, Rachakonda Commissionerate, registered for the offence punishable under Section 108 read with 3(5) of BNS.

The brief facts of the case are that, the de-facto complainant, who is the father of the deceased, lodged a report before the police on 27.12.2025 stating that his daughter was married as accused No.1 in July 2025, after their marriage, they were living together in a rented house at Mallapur. On 26.12.2025, he received a phone call from accused No.1 stating that his daughter committed suicide by hanging herself to a ceiling fan. He suspected accused Nos.1 to 3 were responsible for the death of the deceased and requested the police for necessary action. Based on the said complaint, police registered a case for the aforementioned offence against the accused. 3.
Heard Sri Jarupula Raj, learned counsel appearing for the petitioners as well as Sri E. Ganesh, learned Assistant Public Prosecutor appearing on behalf of the respondent - State. 4.
Learned counsel for the petitioners submitted that the petitioners are innocent of the allegations and they never resided with accused No.1 and the deceased, as they were residing elsewhere. He further submitted that the deceased never visited the house of the petitioners and that the petitioners never had any interaction or communication with the
deceased. Therefore, prayed the Court to grant pre-arrest bail to the petitioners by allowing the Criminal Petition. 5.
On the other hand, learned Assistant Public Prosecutor opposed the submissions made by the learned counsel for the petitioners, contending that allegations are leveled against these petitioners also and due to the instigation of accused No.1, these petitioners harassed the deceased, as such the deceased committed suicide. Therefore, he prayed the Court to dismiss the Criminal Petition.

In light of the submissions made by both learned counsel and upon a perusal of the material available on record, it is observed that there are no nexus between the deceased and the petitioners and that they never abetted the deceased to commit suicide and never harassed her at any point of time. Considering the nature of allegations against these petitioners, custodial interrogation does not appear necessary at this stage. In view of the facts and circumstances of the case, this Court deems it fit to grant pre-arrest bail to the petitioners, subject to the following conditions:
i.
The petitioners shall surrender before the Station House Officer, Balapur Police Station, Ranga Reddy District within two weeks from today, and on such surrender, the petitioners shall be released on bail on executing a personal bond for Rs.25,000/- each with two sureties, for the like sum each.
ii.
The petitioners shall abide by the other conditions stipulated in Section 482(2) of Bharatiya Nagarik Suraksha Sanhita, and co-operate with the Investigating Officer in investigating the case.
iii.
The petitioners shall appear before the concerned Investigating Officer on every Monday between 09:00 a.m, and 05:00 p.m., or till the filing of the charge sheet, whichever is earlier, and thereafter, as and when required.

Accordingly, this Criminal Petition is allowed. Miscellaneous applications, if any pending, shall stand closed.
