HONOURABLE Dr. JUSTICE B.SIVA SANKARA RAO CIVIL REVISION PETITION Nos.5411, 5345 and 5352 of 2016 COMMON ORDER :
These revisions are filed by the petitioner/ defendant, aggrieved by the orders dated 02.09.2016 in I.A.No.395 of 2016 in O.S.No.230 of 2009, I.A.No.397 of 2016 in O.S.No.294 of 2009 and I.A.No.396 of 2016 in O.S.No.231 of 2009 passed by the Additional Senior Civil Judge, Srikakulam.
Heard both sides and perused the impugned orders of the lower Court dismissing the proposed lengthy amendment sought to the respective written statements in the three suits. The contention that even the proposed amendment brought to the notice of the counsel in preparing the written statement it was not cause incorporated is untenable for not a few sentences even to say any inadvertence ignoring. Hence, there are no grounds to interfere with the detailed and reasoned dismissal orders of the lower Court.
Accordingly, all the revisions are dismissed. However, it will not prejudice any available rights from the material on record before the trial Court to work out.
Miscellaneous petitions pending consideration, if any, in this case shall stand closed in consequence. There shall be no order as to costs.
