THE HON'BLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No.860 OF 2024 ORDER:

This Criminal Petition is filed under Sections 437 and 439 of Code of Criminal Procedure, 1973 (for short "Cr.P.C") seeking regular bail to the petitioner/Accused in S.C.No.720 of 2023 on the file of Principal Senior Civil Judge-Cum-Assistant Sessions Judge, Ibrahimpatnam, registered for the offences under Section 306 of IPC.

Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the respondent-State and perused the record.

The petitioner is facing prosecution under Section 306 of IPC. He was granted bail by the Sessions Court imposing one of the condition that he shall not leave the country without permission of the Court. However, he violated the said condition and left to Australia. Thereafter, Look Out Circular (LOC) was issued and the petitioner was apprehended.

Learned counsel for the petitioner would submit that petitioner had assisted investigation and also was present during the committal proceedings. However, due to urgency, he went to

Australia and when he came back to attend the Court, he was arrested.

Keeping in view that the petitioner is a student and now is facing trial in India, the prayer for regular bail can be considered, subject to following conditions:- i) The petitioner/Accused shall execute personal bond for a sum of Rs.1,00,000/- (Rupees One lakh only) with two sureties, for a like sum each to the satisfaction of the Principal Senior Civil JudgeCum-Assistant Sessions Judge, Ibrahimpatnam. ii) The petitioner/Accused after release shall appear before concerned Court on every date of hearing.

iii) The petitioner/Accused shall surrender his Passport before the trial Court and he shall not leave Hyderabad without permission of the Court.

iv) The petitioner/Accused shall abide by the other conditions stipulated under Section 437(3) of Cr.P.C.
