O R D E R

Petitioner is a company and is represented by its Managing Director. Aggrieved by the action of the 3rd respondent - Tahsildr, in entertaining the mutation application of unofficial respondents despite the pendency of the suit filed by the petitioner in O.S.No.142 of 2017 on the file of the Senior Civil Judge, Bhongir, in respect of the subject land, the present writ petition is filed.

Learned counsel for the petitioner submits that the 3rd respondent issued notice dated 08.01.2020 calling upon the petitioner to submit any interim orders in the suit filed by it in O.S.No.142 of 2017 and in pursuance of the said notice, petitioner has filed a detailed explanation on 13.01.2020 to the 2nd respondent - District Collector, but without taking into consideration the said explanation, the 3rd respondent - Tahsildar, is contemplating to mutate the names of unofficial respondents in the revenue records.

Learned Assistant Government Pleader for Revenue, on instructions, submits that vide the notice dated 08.01.2020, the 3rd respondent sought the petitioner to produce the interim orders, if any, passed in the suit filed by it in O.S.No.142 of 2017, but the petitioner without producing any interim orders, claims to have submitted an explanation on 13.01.2020 that too to the 2nd respondent - District Collector, and immediately thereafter, filed the present writ petition. He submits that the present writ petition is not maintainable.

Since the 3rd respondent has already issued notice dated 08.01.2020 to the petitioner, and petitioner is stated to have filed explanation on 13.01.2020 to the 2nd respondent, without expressing any opinion on merits, writ petition is disposed of directing the 3rd respondent to take into consideration the objections raised by the petitioner in the explanation stated to have made on 13.01.2020, and take further action in accordance with law.

Interlocutory applications pending, if any, shall stand closed. No order as to costs.
