HONOURABLE SRI JUSTICE CHALLA KODANDA RAM CONTEMPT CASE No.144 of 2019 ORDER:

This Contempt Case is filed complaining non-compliance of the order, dated 04.9.2018, passed by this Court in Writ Petition No.31516 of 2018.

While disposing of the aforesaid Writ Petition at the admission stage, by order dated 04.9.2018, this Court directed the respondent to conclude the proceedings initiated under the provisions of the A.P. Assigned Lands (Prohibition of Transfers) Act, 1977, within a period of eight weeks from the date of receipt of a copy of that order. The petitioners assert that the aforesaid order was served on the respondent on 17.11.2018. In the counter-affidavit filed by the respondent, it is specifically asserted that the aforesaid order was served on him on 18.12.2018; that notice was issued to the parties concerned on 21.12.2018; that the statements of the parties were recorded on 27.12.

2018; that thereafter the respondent proceeded to conduct local inspection to examine the witnesses and the alleged sale deeds; that as the witnesses were not present, the matter was adjourned to 02.3.2019; that on 02.3.2019 the witnesses were present and the enquiry was concluded; that the final orders were passed on 08.3.2019; and that in the aforesaid process, there occurred a delay of 20 days in passing the orders, which is neither willful nor wanton. No reply-affidavit is filed by the petitioner denying the aforesaid averments in the counter affidavit.

Considering the nature of enquiry which was undertaken by the respondent and as the aforesaid order of this Court has been complied with, though with a delay of 20 days which is condonable, the Contempt Case is closed, however, with a caution to the officers of the Revenue Department that in the event, they are unable to comply with the orders of this Court within the stipulated period, be it for whatever reasons, they shall seek extension of time but not give explanation for the delay.

Pending Miscellaneous Petitions, if any, shall stand closed. No order as to costs.
