This writ petition is filed seeking a direction to respondents 2 and 3 to release the Omni bus bearing No.TS05UC0071 belongs to the petitioner.
Learned Assistant Government Pleader for Transport on instructions submits that the subject vehicle was seized on 07-01-2020 by respondents 2 and 3 on the ground that the petitioner has not paid the tax from 31-12-2016 to 31-032020 amounting to Rs.5,29,380, penalty of Rs.9,81,320/- and compounding fee of Rs.19,030/-.
Learned counsel for the petitioner submits that the petitioner has alternative remedy of appeal against imposing of penalty.
In view of the facts and circumstances of the case, this writ petition is disposed of directing the respondents to release the subject vehicle on production of original RC and on payment of Rs.5,29,380/- and compounding fee of Rs.19,030/- and also subject to producing driving licence of driver, who drives the subject vehicle. However, payment of penalty will be subject to further orders in the appeal to be filed by the petitioner within a period of (30) days and if the petitioner does not prefer the appeal within (30) days, it is
open for the respondents to recover the penalty from him in accordance with law. No order as to costs. As a sequel, miscellaneous applications pending, if any, shall stand closed.
