ORDER
Petitioner seeks a writ of mandamus to direct the respondents not to insist for NOC in respect his house bearing H.No.16-2738/4/5/1/2/A/1 (old 16-2-738/4/5/1/2/1), admeasuring 171.0 sq. yards equivalent to 142.97 sq. meters, situated at S.B.H. Colony, New Malakpet, Hyderabad.

Learned counsel for the petitioner submits that the issue in the present writ petition is squarely covered by the judgment of this Court in Hyderabad Potteries Private Limited v. Collector, Hyderabad District1. He further submits that in the shortfall letter dated 23.11.2016 communicated to the petitioner, there is no demand to produce NOC.

Having regard to the facts and circumstances, the petitioner is at liberty to approach the respondents by fulfilling the items mentioned in the shortfall letter, and if there is any specific demand with regard to production of NOC, the respondents shall issue the same in writing to the petitioner so as to enable him to avail the remedies as available under law.

With the above observation, the Writ Petition is disposed of. No order as to costs.
