THE HON'BLE SRI JUSTICE SANJAY KUMAR AND THE HON'BLE Dr. JUSTICE B. SIVA SANKARA RAO WRIT APPEAL No.1445 of 2008 JUDGMENT: (Per Hon'ble Sri Justice Sanjay Kumar) This writ appeal arises out of the order dated 24.07.2008 passed by a learned Judge in W.P.No.15960 of 2008. By the said order, the learned Judge followed the earlier judgment dated 15.07.2008 passed in W.P.No.11490 of 2008 and invalidated the transfer policy.

It is now brought to our notice that Writ Appeal Nos.792, 795 and 796 of 2008 were preferred by the Bharat Sanchar Nigam Limited aggrieved by the common order dated 15.07.2008 passed in W.P.Nos.13014, 15065 and 11490 of 2008 and by common order dated 04.11.2009, a Division Bench of this Court reversed the order of the learned Single Judge and upheld the transfer policy. In that view of the matter, as there was no independent adjudication in W.P.No.15960 of 2008 and the order passed in W.P.No.11490 of 2008 was followed, the common order passed in the afore-stated writ appeals would prevail.

The order under appeal is accordingly set aside. The writ appeal is allowed.
