This writ petition is filed challenging the order dated 09-09-2016 refusing to register the document presented by the petitioner on the ground that the same is in the prohibited list furnished by M.R.O./Tahsildar, B.Kothakota communicated the memo to the District Registrar.

Full Bench of this Court in Vinjamuri Rajagopala Chary v. Principal Secretary, Revenue Department, Hyderabad1 (W.A.No.343 of 2015 and Batch dated 23-12-2015) held that it is for the District Collector to send list prohibiting the properties from registration in respect of properties falling under Section 22-A (1) (a), (b) and (d) of the Registration Act. It is the Commissioner of Endowments or Secretary to Wakf Board is competent to send list of properties falling under Section 22-A

(1) (c) of the Act. But in this case, it is found that refusal order is passed on the list sent by Tahsildar. In view of the same, the impugned order is set aside. The 3rd respondent is directed to entertain the registration of the document presented by the petitioner and register the same, if it is not in the prohibited list of properties sent by competent authorities as held by Full Bench of this Court in the judgment cited supra.

With the above direction, this writ petition is disposed of. There shall be no order as to costs. As a sequel thereto, miscellaneous petitions, if any, pending in this Writ Petition, shall stand closed.
