THE HON'BLE SRI JUSTICE T.VINOD KUMAR WRIT PETITION No.1928 OF 2020 ORDER:
The present Writ Petition is filed to declare the action of respondent Nos.2 to 4, particularly the 2nd respondent, in interfering with the peaceful possession and enjoyment of the petitioner over the land to an extent of Ac.1.27 gts situated in Sy. No.90/3, Ac.0.23 gts in Sy. No.91/3 of Yarravaram village, Kodad Mandal, even though the subject matter was ceased by the competent civil Court i.e., the learned Junior Civil Judge, Kodad in O.S. No.5 of 2015, as being illegal, arbitrary and in violation of Article 21 of the Constitution of India.
Heard Sri K. Laxmaiah, learned Counsel for the petitioner and learned Assistant Government Pleader for Home. Learned Assistant Government Pleader for Home, on written instructions dated 31.01.2020, submits that the petitioner gave a representation to the 4th respondent on 31.12.2019 alleging that she has obtained orders in O.S. No.5 of 2015 from the Junior Civil Judge, Kodad and that on 31.12.2019, the 5th respondent and others interfered in their lands, dragged her out of her fields and threatened to kill her.
By the said written instructions, it is stated that on receipt of the above petition, a G.D. entry was made and enquiry was done, during enquiry, it disclosed that the said 5th respondent was not present in the village on 31.12.2019, as such the petition given by the petitioner was closed on 01.01.2020. By the said written
instructions, while denying the claim of the petitioner that the respondent No.2 is interfering with the peaceful possession and enjoyment of the petitioner, it is stated that the respondent authorities never interfered in the civil dispute of the petitioner at any point of time, except causing enquiry on the petition given by the petitioner.
Having regard to the above submission made on behalf of the respondent authorities, no further orders need be passed in this Writ Petition.
Accordingly, the Writ Petition is closed. No order as to costs. As a sequel thereto, miscellaneous petitions, if any, pending shall stand closed.
